Students: showing satisfactory progress
Two recent cases in the Asylum and Immigration Tribunal (AIT) have examined the requirement in the UK Immigration Rules that a student applying for an extension of stay as a student must show satisfactory progress in their studies. It is for a student to satisfy the immigration rules and demonstrate that they are making satisfactory progress. They are not entitled to a warning before being refused an extension of stay on this basis (KL (Student: IDI 'warning' about progress) India 2007 UKAIT 00005). To satisfy the rules on satisfactory progress, the student must show satisfactory progress on the course for which she or he was granted leave. Other progress is not relevant (TY (Student; 'satisfactory progress'; course of study) Burma [2007] UKAIT 00007).
