GHERSON SECURES ANNULMENT OF EU SANCTIONS AGAINST SERGIY KLYUYEV
Today, 28 January 2016, the General Court of the EU has annulled the financial sanctions imposed upon Ukrainian MP Sergiy Klyuyev by the EU Council from March 2014 to March 2015.
These sanctions were imposed following the overthrow of Victor Yanukovych's Government. We have maintained throughout that these sanctions are nothing more than a politically motivated attack on him by elements of the new government in Ukraine.
Roger Gherson and Thomas Garner of GHERSON solicitors and Brian Kennelly QC of Blackstone Chambers have been instructed in the case since April 2014 and today marks the culmination of 19 months of litigation before the EU Court.
Following the hearing of this case, fresh sanctions were imposed by the EU and these are also the subject of a further legal challenge. The judgment confirms that the 'evidence' relied upon by the Council to impose the sanctions in March 2014 was wholly inadequate. The evidence currently relied on by the Council is no better. In view of today's judgment, the current sanctions are unsustainable. We will be making that point to the Council and the General Court. These sanctions are fundamentally flawed and today's judgment is an important first step in securing a complete victory for our client.
The imposition of these sanctions has caused our client and his family significant distress and reputational damage and has had a devastating effect on his business interests. Our client welcomes today's verdict and intends to aggressively pursue damages for the harm these sanctions have caused.
