Home Office Refuses to Believe Applicant Made An Immigration Application... Then Return Supporting Documents To Him In R (On the Application Of Ufot) v Secretary of State for the Home Department [2016] EWCA Civ 298 the Court of Appeal subjected the SSHD to stinging criticism both for the way in which she handled the application and the management of the subsequent litigation. It is hard not to sympathize with the Appellant, a Nigerian national,... Read more »

2014 was a year of significant changes for UK immigration law. The year saw the implementation of the Immigration Act 2014 with wide ranging changes to removals, and appeals. However we only saw a mere six Statements of Changes in the Immigration Rules, (a welcome reduction from the eleven we had in 2013). There is no doubt that 2015 will see more changes. Immigration is a hot political topic and will continue to be so in the lead up to the general election. The current Government's rhetoric... Read more »

In late December 2014 Home Secretary Theresa May proposed to implement changes to the Immigration Rules in respect of Tier 4 students. These would require foreign students wishing to switch their course of study or apply for a visa in work categories to return to their country of origin in order to apply for any such type of visa. Under the current Immigration Rules students on courses of 12 months or more are given an extra 4 months on their visas in addition to the duration of their course;... Read more »

The former Conservative deputy Prime Minister, Lord Heseltine, this week told the BBC, at the Conservative Party Conference, that he favours excluding foreign students from the present Government's target of cutting net migration below 100,000 by the time of next year's General Election - a target Government sources have privately admitted is unlikely. His comments come following the publication of a joint poll by the thinktank British Future and Universities UK, the umbrella... Read more »

International students are permitted to enter the UK to study at London Metropolitan University. Currently, there is a limit on the number of international students that the university can enrol. In line with Home Office policy, the university is now subject to a probationary period in order to build a track record of compliance with the new students as they enrol. The Home Office has overturned a ban on London Metropolitan University admitting students from outside... Read more »

Shadow Home Secretary Yvette Cooper outlined Labour's new approach to immigration last Thursday in an attempt to seize the initiative from a Coalition fraying at the edges and struggling to reach a consensus on its own policy. Despite the Prime Minister stressing that the party would not "lurch to the right" in the wake of the Eastleigh by-election, the rhetoric from some ministers has seemingly been at odds with this statement. Home Secretary Theresa May has announced plans to... Read more »

In a dark period of credit downgrades and humiliating by-elections the drop in net migration looked like a glimmer of hope for the coalition. The pledge to bring net migration down to 'the tens of thousands' has filtered through from a Conservative Party manifesto to the forefront of immigration policy. After humiliating rises in 2010 the Office for National Statistics revealed that net migration had fallen by a third to 163,000. Immigration Minister Mark Harper stated that "our tough reforms... My abiding perception after listening to the Home Office on Thursday is that it is all about 'abuse'. Stamp out abuse and the migration figures will start to resemble the government's projected targets. When Tier 4 was introduced, I thought I knew what 'abuse' was: bogus colleges that fronted as educational establishments with the sole aim of sponsoring illegal workers without any intention on either side to undertake a course of study. These abusers were giving genuine colleges and students... Read more »

It was announced by the UK Border Agency in July 2012 that following a 'successful pilot' carried out last year, a targeted interview system for students was being introduced, which would concentrate on high-risk applicants . If you are a student, you may be interviewed and asked a number of questions about your immigration and education history, study and post-study plans, and financial circumstances. The UKBA expects to interview up to 14,000 students in the next 12 months.... Read more »

For non-EEA students wishing to study in the UK, the UK is proving itself an inhospitable host. The UKBA's revocation of London Metropolitan University's sponsor licence , leaving thousands of foreign students to face deportation, was just one instance in what seems an emerging pattern of cynical disregard of non-EEA students. To add insult to injury, last week hordes of foreign students were forced to queue for hours outside the Overseas Visitors Records Office (OVRO), subjected... Read more »
