Whilst Tier 1 Entrepreneur applications have for the past couple of years been subjected to the Genuine Entrepreneur test the Home Office are increasingly applying the test to challenge this type of application and in particular initial entry clearance applications. The test is applied for extension, switching categories and Indefinite Leave to Remain applications and is conducted if the Home Office has doubts over the credibility of an application. The test can be carried out in... Read more »

The subject of the EU referendum is a hard one to avoid, with both campaigns showing a high level of engagement. Despite the extraordinary complexity of the issue, it is necessary to objectively understand the differences between the immigration system and the proposed alternative in order to make an informed decision. There has been a lot of talk from the leave campaign about a possible new points-based system for EU nationals. Despite comparisons made from both sides to the Australian... Read more »

Did the Home Office intend to jeopardise the Tier 1 Investor category? On 26 February 2015, the Government announced further sweeping changes to UK immigration law in a new Statement of Changes to the Immigration Rules ("the Rules"). The changes run to some 215 pages. An Explanatory Memorandum accompanies the Statement of Changes, in which the Home Office issues an apology for not providing the normal 21 days' notice: instead, the notice period was just one weekend because the changes generally... The changes to the Immigration Rules mean that Tier 1 (General) migrants can no longer extend their leave to remain after 5 April 2015 or apply for indefinite leave to remain ("ILR") in the UK after 5 April 2018. When it opened in 2008, the Tier 1 (General) category was announced as a way to attract the best and the brightest to the UK. Shortly after their election, the current government set about closing the Tier 1 (General) route and it was completely closed to new applicants after April... Read more »

2014 was a year of significant changes for UK immigration law. The year saw the implementation of the Immigration Act 2014 with wide ranging changes to removals, and appeals. However we only saw a mere six Statements of Changes in the Immigration Rules, (a welcome reduction from the eleven we had in 2013). There is no doubt that 2015 will see more changes. Immigration is a hot political topic and will continue to be so in the lead up to the general election. The current Government's rhetoric... Read more »

It is becoming more and more expensive to live in the UK. Forget inflation and rocketing house prices - for some it costs literally millions to simply gain the right to live in the UK and apparently, judging by the reported rise in investor visas recently, it's worth the money. Given the Coalition Government's crackdown on immigration and the subsequent restrictions on (or even closure of) various categories under the Points-Based System, obtaining the right to live and work in the... Although 2012 had strong beginnings for the property market, i.e. January mortgage approval levels were the highest since late 2009, many economists still do not consider the London market's future prospects optimistically. Earlier this month Halifax published a series of gloomy figures which further diminished confidence in the UK housing market. A combination of reluctant sellers and nervous buyers has resulted in stagnation. Low and fragile consumer confidence, muted earning growth... Read more »

The UK remains one of the world's most popular destinations for foreign investors and entrepreneurs, with 28 ventures and nearly 2,000 jobs created here each week. According to Business Secretary Vince Cable, more than two thirds of the jobs created or safeguarded in 2010/2011 came from existing investors. The World Bank says that the UK is the easiest place to do business out of all the EU and G8 countries while Ernst & Young have confirmed that the UK is the... Read more »
